Terms and Conditions of Looking For Lighting Limited
a) The ‘Seller’ means Looking For Lighting Limited.
2. Orders and Payment
a) Orders are only accepted subject to the condition of sale set out below, the seller shall not be bound by any other terms, written, verbal or implied, or which are conditions customary in the trade and whether contained in customers order forms or not. The Seller conditions shall apply unless expressly varied by the seller in writing.
b) All orders must be received in writing, any amendments to your order must also be received in writing.
a) The price of the goods shall be the Sellers quoted price, the Seller reserves the right, by giving notice to the Buyer at any time before delivery, to increase the price to reflect any increase in the cost to the Seller which is due to any factor beyond the control of the Seller, any change in delivery dates, quantity or specifications for the goods or services which is requested by the Buyer, or any delay caused by the instructions of the buyer to give the Seller adequate information or instructions.
4. Delivery and Risk
a) Goods are delivered to the buyer when the seller makes them available to the buyer or any agent of the buyer at the Sellers premises or other delivery point agreed by the Seller and risk in the goods passes when they are delivered to the buyer.
5. Title of Goods
a) Title of goods shall only pass when payment has been received in full.
6. Damages and Returns
a) In the event of receiving damaged or missing goods, and where liable, Looking For Lighting will endeavour to rectify the situation as long as the Buyer has reported the damages and shortages within 2 working days of receipt of goods, the Buyer must notify the Seller if the goods are not due to be unpacked within 2 days of receipt.
a) Orders cancelled once manufacture is underway, or goods returned for reasons of unsuitability will be accepted at the manufacturer’s disgression who reserve the right to charge a re-stocking fee once the goods have been returned at the buyer’s expense directly to the manufacturer’s choice of destination. Goods must be returned as per instruction of the manufacture in a re-saleable condition before the manufacture will agree to a refund subject to a restocking fee. All items that are unsuitable must be returned within 21 days of receipt of order.
8. Breach or Insolvency
a) If the buyer breaches any conditions of this contract or becomes subject to an administration order or becomes bankrupt or has a receiver appointed or distress is levied on any part of its assets or business or goes into liquidation or makes any composition with its creditors, the seller shall be entitled (whether in respect of this or any other) to: 1. Withhold any further deliveries to the Buyer and/or cancel the contract without liability. 2. Appropriate any payment made by the buyer to such of the goods (whether supplied under this contract or any other) as the Seller shall think fit. 3. Immediate payment of all sums whatever, owing by the Buyer to the Seller notwithstanding any previous agreement to the contrary. 4. Exercise any of its right pursuant to the retention of title to the goods.
9. Product Information
a) Although the Seller shall use its best endeavour to ensure that the information contained in the Sellers description of goods is correct e time of entry, the Seller shall not be under liability for any damage, loss or expense resulting from any error or omission contained in the Seller description be it in a catalogue or written on the website and associated documentation.
10. Law and Jurisdiction
a) All disputed in connection with the contract shall be governed by English Law. Buyer accepts the jurisdiction in courts of England.
